Around 8,000 retired officers of the NOAA Commissioned Officer Corps and the U.S. Public Health Service Commissioned Corps carry a risk no other uniformed retiree has: their pension checks can legally stop during a government shutdown, and in the fall 2025 lapse, they did. The House passed a fix on July 24, the bipartisan Pensions for Retired Uniformed Servicemembers Act (H.R. 8732). The Senate hasn't touched it, and the next funding cliff is October 1.
The Two-Tier System Nobody Designed on Purpose
All eight uniformed services compute retired pay with the same Title 10 formulas. What differs is the account the checks come from, and that difference decides who gets paid in a shutdown.

The mechanism is the Anti-Deficiency Act. The Military Retirement Fund, created in 1983 and codified at 10 U.S.C. 1461-1467, is a permanent standing appropriation: the money stays legally "available" whether or not Congress has passed this year's spending bills. NOAA and USPHS retired pay comes from annually enacted Commerce and HHS accounts. When those lapse, there is no available appropriation, and payment can't legally go out.
The Coast Guard used to sit on the wrong side of this line too. Congress moved it into the Military Retirement Fund in the FY2021 NDAA after shutdown scares. NOAA and USPHS were left behind.
What Happened in Fall 2025
During the 43-day lapse from October 1 to November 12, 2025, NOAA Corps and USPHS retirees got their October 1 deposit and then missed October 31 entirely, while every DoD and Coast Guard retiree was paid on schedule. For roughly 8,000 households, many of them retired physicians, engineers, and scientists in their 60s through 90s, a pension that had been treated as untouchable simply skipped a month.
That's the event driving H.R. 8732.
What H.R. 8732 Does
The Pensions for Retired Uniformed Servicemembers Act, sponsored by Reps. Jamie Raskin (D-MD), Don Bacon (R-NE), and Maxine Dexter (D-OR), applies the Coast Guard fix to the last two services: it moves NOAA Corps and USPHS Corps retirement obligations into the DoD Military Retirement Fund, with Commerce and HHS making actuarially determined contributions into the fund instead of paying retirees from annual accounts. Retiree checks would then draw from a permanent appropriation, immune to lapses.
The House passed it July 24, 2026. As of this writing it has not been introduced in the Senate, and no companion bill exists.
There's also a legal track worth watching: a class action being prepared for the Court of Federal Claims argues NOAA and USPHS retirement statutes are "money-mandating" under the Tucker Act, meaning the payments were legally owed even during the lapse. That case had not been filed as of late July.
The October 2026 Collision Course
The exposure fires again if two things are both true on October 1: appropriations (or a CR) haven't been enacted, and H.R. 8732 isn't law. Right now neither chamber has finished its half. The House passed a clean CR through December 4 (H.R. 9770, tracked here) on July 21; the Senate hasn't voted on it. And the pension fix is sitting in the Senate's inbox.
